Dr. Whalen is experienced in providing medical legal testimony for plaintiffs, defendants, prosecutors and regulatory agencies in medical malpractice, personal injury, work injuries, criminal cases, administrative and licensing board issues. He is considered an expert in workers’ compensation by his peers and the State of California Division of Workers Compensation, and is an expert consultant for the California Board of Chiropractic Examiners. He has testified on issues of boundaries, standard of care, treatment issues, billing, documentation and disability. He provides evaluation of potential legal cases, independent medical examinations (IME), and case reviews.
As a Past President of the California Chiropractic Association and Chair of the Emeritus Council of the Clinical Compass ( formerly the Council on Chiropractic Guidelines and Practice Parameters) Dr. Whalen has extensive and unique experience and qualifications in addressing issues of standard of care. In addition he co-authored multiple “Best Practice” documents regarding chiropractic care for low back pain, neck pain, chronic pain and other issues for the chiropractic profession which have been published in the peer-reviewed scientific literature.
Based on his extensive clinical and legal experience, he is happy to provide an unbiased, independent review of cases with an honest and informed assessment of the strengths and liabilities of specific cases, and is never reluctant to advise retaining counsel that the facts simply do not support their position, but when they do, he can be a powerful, experienced and effective expert witness to support the facts of the case.
